(gegenphilosophische) Reflexion Ÿber das Recht
Betrachtungen zu Derrida
Abstract: This article intends to ãreconstructÒ
and discuss DerridaÕs conception of law. The main challenge is this
ãcounterpointÒ: law
(as language and power) / justice (the exercise of justice) as law and right / justice as deconstruction (as a ãresponsibility without limitsÒ).
The development is concerned with the ãdeconstructive wayÒ of thinking contexts
(as a dialogue with speech act theory), the ãpromise of democracyÒ (and the
possibilities of a critical ãemancipationÒ), but also ethics (as the experience
of ãabsolute alterityÒ). Do the problems of singularity and judgement condemn
us to unsurpassable aporias? Does DerridaÕs understanding of law (and right)
respect diffŽrance or
the ãindefinite openigÒ (the ãessential nontotalizationÒ) of the involved
contexts?
