Alfonso García Figueroa, Toledo (Spanien): Bemerkungen zu einer dispositionellen Erklärung des Rechts anhand der Diskussion der Verbindungs- und Trennungsthese

This article shows how Positivism and Jusnaturalism are answers to one wrong question (a pseudoproblem). They may be considered as parts of one and the same paradigm based on two presuppositions, namely dualism and objectualism. This paradigm gives no suitable understanding of two main transformations of practical discourse: (legal) Constitutionalism and (ethical) Constructivism. A new paradigm, i.e. neoconstitutionalism, based on the idea of unity of practical reason and a dispositional conception of correction provides a better framework to study these changes. Within this framework, the article examines the discussion between Robert Alexy and Eugenio Bulygin concerning the relationship between Law and morality.
